Use of Site Is Agreement to Terms of Use and Privacy Policy
By using this website, you agree to be bound by and comply with the following Terms of Use, our Privacy Policy, and any other notices or disclaimers contained on this website. These Terms of Use apply to all websites operated by the Greater Kansas City Community Foundation, Greater Horizons, or their affiliates, including but not limited to the Hispanic Development Fund and Black Community Fund websites (collectively, “the Community Foundation” or “we,” “us” or “our.”). If you do not agree to these Terms of Use, or if you violate these Terms of Use, you may not continue to use or access any website operated by the Community Foundation (the “Sites”).
Please also review our Privacy Policy, which provides information about how we may collect, use, maintain, disclose and protect your personal data when you access or use our Sites.
We may change these Terms of Use from time to time. The date of the most recent material revision will be printed at the bottom of these Terms of Use. You are responsible for periodically checking these Terms of Use for changes. By continuing to use the Sites, you are agreeing to the terms of the most recent Terms of Use posted to the Sites.
Age Requirements
If you reside in the United States, you must be at least 13 years old to access or use our Sites and able to form a binding contract with us, which may require that your parent or guardian agree to be bound by these Terms. If you reside outside of the United States, you must be at least 18 years of age to access or use our Sites and able to form a binding contract with us.
User Account
If you are associated with a charitable fund that we administer, you may be authorized to access our online donor portal. If so, we will invite you to access your donor portal account (“Account”) by creating a password for your Account. You are responsible for maintaining the security of your password and for all activities that occur under your Account or password. You represent and warrant that all information you provide in connection with your Account (“User Information”) is current, complete and accurate, and that you have the permission to share the User Information with us. Please notify us if you become aware of any issues with the security of your Account. You grant the Community Foundation the right to use the User Information in connection with providing services to you.
We reserve the right to terminate your Account for any reason or no reason, in our sole discretion, including for non-use or a violation of these Terms of Use.
Allowable and Prohibited Uses
You may access and use your Account for your non-commercial, personal use (an “Authorized Use”). A representative of a fund established by a company or charitable organization may access and use their Account for the company’s or charitable organization’s internal use related to that fund (also an “Authorized Use”).
Financial advisors managing Community Foundation funds may access and use their Account in connection with providing services to the Community Foundation, which use is considered an “Authorized Use.”
You may not:
- otherwise access or use your own or any other user’s Account for the purpose of providing services to any third party or for other commercial purposes, regardless of whether such use is for for-profit or non-profit purposes;
- use any spider, scraper, robot, aggregator, site search/retrieval application or other automated similar means or device to use or access the Sites, including for monitoring, retrieving, data mining, downloading, indexing or copying any content on the Sites, unless it is for an Authorized Use;
- use any manual process to monitor or copy any Content on the Sites, unless it is for an Authorized Use;
- use the Sites in any manner that would slow or damage the Sites, interfere with others’ use of the Sites, or otherwise interfere with the proper working of the Sites;
- attempt to gain unauthorized access to any parts of the Sites, the server on which the Sites are stored or any computer or database connected to the Sites;
- attempt to reverse engineer, decompile, disassemble, decode or otherwise attempt to gain access to the source code of any portion of the Sites;
- use the Sites in an attempt to collect personal information about users or third parties without their consent;
- use the Sites to solicit any users of the Sites for any commercial purposes;
- use the Sites or create an Account under false pretenses or to engage in any fraudulent activity; or
- use the Sites in any matter that violates any local, state, national or international law or regulation or that violates these Terms of Use.
Intellectual Property
The Sites, and all materials, content, and services provided through the Sites (the “Community Foundation Content”), including all trademark, copyright and other intellectual property rights, are the property of, or licensed to, the Community Foundation. Except as necessary for your personal use of the Sites or an Authorized Use, you may not copy, modify, transmit, broadcast, repost, publicly display, frame, deeplink or otherwise distribute the Community Foundation Content in any way or on any other website. You may downland and retain information from your Account for your personal records.
You may not use the Community Foundation’s name, logo, trademarks, service marks, designs or slogans without our express prior written permission.
Sites Are for Information Only
All information and examples provided through the Sites are provided for general informational purposes only, and are NOT intended to be tax, accounting or legal advice. Please consult a tax advisor, accountant or lawyer for independent advice tailored to your specific circumstances before taking any actions. We make no representation or guarantee that the information and examples provided on the Sites are reliable, accurate, complete or suitable for you or your specific circumstances.
We expressly disclaim any responsibility or legal liability to anyone for any types of damages caused by or in connection with the reliance on information, examples, or other content made available on the Sites, including without limitation, where there may be errors or omissions in the information and examples provided on the Sites.
The Sites are provided on an “as is” and “as available” basis. We may change the Sites at any time, including by removing, changing or blocking access to the Sites, any portions of the Sites, or functionality of the Sites.

Limitation of Liability
IN NO EVENT WILL THE COMMUNITY FOUNDATION, ITS OFFICERS, DIRECTORS, EMPLOYEES, REPRESENTATIVES OR AGENTS BE LIABLE TO YOU OR ANY THIRD PARTY FOR ANY INDIRECT, CONSEQUENTIAL, INCIDENTAL OR EXEMPLARY LOSSES OR DAMAGES, ARISING FROM OR IN CONNECTION WITH YOUR USE OF THE SITES. IN NO EVENT WILL SUCH PARTIES BE LIABLE FOR ANY DIRECT DAMAGES ARISING FROM OR IN CONNECTION WITH YOUR USE OF THE SITES, EXCEPT TO THE EXTENT ARISING OUT OF THE COMMUNITY FOUNDATION’S GROSS NEGLIGENCE OR WILLFUL MISCONDUCT.
Governing Law
These Terms of Use shall be construed under the laws of the State of Missouri.
